TERMS AND CONDITIONS

Below are Aurelie Maron Pty Ltd (throughout this document will be referred to as Aurelie Maron Studio) standard terms and conditions. It is vital that you (The Client) please take time to read through thoroughly and ensure you fully understand these terms and conditions and their implications before you commence any project with Aurelie Maron Studio. Please also note that from time to time Aurelie Maron Studio may need to alter these terms and conditions without notice. Please contact us if you do not understand any of the terms and conditions in this document.

COMMENCEMENT OF WORK

1. AGREEMENT

Agreement to work with and payment of a deposit to Aurelie Maron Studio constitutes agreement to these terms and conditions.

SCHEDULE PARAMETERS

2. WORK HOURS/DAYS

This agreement assumes work will be completed within the standard work week (Monday through Friday, from 9am to 5pm). Aurelie Maron Studio is closed on all major holidays and the entire week of Christmas and New Year’s.

3. SCHEDULE

The work outlined in this agreement will be turned around within a reasonable, non-rush schedule to be determined, where possible, and mutually agreed upon at the start of each project. Late or weekend hours incurred to accommodate additional compressed deadlines, if needed, will be negotiated separately. Our schedules assume timely review and response by the client of all deliverables.

CLIENT RESPONSIBILITIES

4. CLIENT REPRESENTATIVE

The client has full authority to provide and obtain all necessary information and approvals throughout this project. The client represents that he has full power and authority to enter into this agreement and that it is binding upon Aurelie Maron Studio and himself and enforceable in accordance with its terms.

5. CLIENT RESPONSIBILITIES

The client will provide accurate, complete and timely information and materials to Aurelie Maron Studio. The client guarantees that he has all the necessary rights and ownership in such materials to permit Aurelie Maron Studio to use them for the project.

6. CLIENT APPROVALS

The client will approve and proofread all final designs, type, press proofs and test sites. Aurelie Maron Studio will make all efforts to ensure that no information is misrepresented. However, the client assumes all responsibility for content. Aurelie Maron Studio does not take responsibility for any errors after client’s approval of any artwork. 

7. CLIENT CHANGES

In order to avoid errors, text changes and corrections will not be taken over the telephone and must be provided electronically via email. Any text with extensive changes must also be provided as marked up hard copy, indicating the revised text. Artwork design includes two changes. Any additional changes will be charged at an hourly rate.

SAMPLES & CREDIT

8. SAMPLES

Aurelie Maron Studio can use samples or photographs of the work created under this agreement and the name of the project for publications, exhibition, competition and other promotional purposes (such as our website) once the project has been made public.

9. CREDIT

The following credit will be mentioned on all publicity or promotion of this project and our relationship, including, but not limited to awards, competitions, press releases, etc. (i.e.: “Design by Aurelie Maron Studio for...”).

PAYMENT PARAMETERS

10. DEPOSIT

 The client agrees to pay a 50% deposit of the quote amount to commence any project, with the balance payable prior to delivery. Once research, resources allocated or design work has commenced on a project, this deposit is non-refundable. In case of a change of mind by the client, this deposit is non-refundable.  

11. DELAYS & TERMINATION

All payments received (including deposits) are not refundable in the event of the project or the relationship is terminated for any reason. If any part of the work for this project is delayed for longer than 30 days, Aurelie Maron Studio will bill for work completed.

12. CONSEQUENCES OF NON-PAYMENT

Aurelie Maron Studio reserves the right to suspend work and withhold issuing any project documents if invoice payments are not received within a reasonable period of time from invoice date.

ELECTRONIC FILES

13. LENGTH OF STORAGE

Aurelie Maron Studio agrees to store all final electronic files created for the client for a maximum of one month.

14. FILE REQUIREMENTS

If the client has specific requirements for how project files must be prepared, he must communicate this, in writing, to Aurelie Maron Studio before the project begins.

COPYRIGHT

15. OWNERSHIP

Ownership of copyright over all concepts and proof artwork remains with Aurelie Maron Studio. Unlawful use of these artwork by the client prior to payment is strictly prohibited and illegal. 

16. TRANSFER OF OWNERSHIP

All artwork will remain the property of Aurelie Maron Studio until account is paid in full. Upon full payment of account, copyright ownership will be transferred to the client.

In accordance with the Australian Copyright Act (1968), ‘licensing of copyright is subject to a mutual agreement made between client and designer’. Copyright will remain property of Aurelie Maron Studio till such time an agreement is in place. As part of Aurelie Maron Studio terms of business, the copyright licence is automatically released to the client on receipt of the final payment for the commissioned work. Aurelie Maron Studio reserve the right to use all artwork produced, concepts produced in the course of the project (including those concepts not selected) and revisions for the purposes of promoting Aurelie Maron Studio in print or digital media portfolios, social media, and blogs, except where the client has specifically requested in writing otherwise.

17. OWNERSHIP LIMITATION

Future re-use or re-print requests of the same artwork will need to be discussed with Aurelie Maron Studio prior to the start of the project (i.e.: Franchises or multiple use of the same artwork will need to be agreed upon first and might result in a commission fee agreement to Aurelie Maron Studio).
